Terms & Conditions

The terms on which Quality Immigration provides immigration consultancy and guidance, and on which this website may be used.

1. About these terms

These terms and conditions apply to the use of this website and to every engagement, quotation and agreement between Quality Immigration and a client, unless we have agreed otherwise in writing. By requesting a consultation or instructing us, you accept these terms.

2. Who we are

Quality Immigration is an immigration consultancy run by Elena Diachenko and established in the Netherlands.

3. Scope of our services

We provide immigration consultancy, guidance and practical support. This includes assessing your situation, explaining the options and requirements that apply to it, helping you prepare and organise documents, and supporting you through the steps of a visa, residence, work, study or naturalisation procedure.

Please note the following, which form an essential part of these terms:

  • We are consultants, not legal representatives. Elena Diachenko is an immigration expert and consultant. We do not act as an advocate or lawyer, we do not provide legal representation before a court or tribunal, and nothing we provide should be read as legal advice within the meaning of the regulated legal professions.
  • We do not guarantee outcomes. Decisions on visas, permits, residence and citizenship are taken solely by the competent authorities of the country concerned. We cannot influence, predict or guarantee their decisions, their processing times, or their interpretation of the rules.
  • Rules change. Immigration rules, fees and procedures can change at short notice and can be applied differently by different offices. Our guidance describes the position as we understand it at the time it is given.
  • Country specific formalities remain your responsibility. Where a matter requires a translation, legalisation, apostille, medical examination, examination or biometric appointment, we can explain and help coordinate it, but you remain responsible for completing it.

Where a matter falls outside our expertise, we will say so and, where we can, point you towards a suitable specialist.

4. Engagement, quotations and fees

An engagement comes into being when we have described the work to be done and you have confirmed your instruction, in writing or by email.

The scope of work and the fee are agreed in writing per engagement, before the work begins. We do not publish a price list, because the work involved differs from one situation to the next. A quotation is valid for the period stated in it and is based on the information available at the time.

  • Government fees, translation, legalisation, courier and similar third-party costs are not included in our fee unless the agreement says so, and are payable by you.
  • Where an agreed scope is extended at your request, or where the matter changes materially, we will agree the additional work and fee with you before continuing.
  • Invoices are payable within the period stated on the invoice. If payment is not made on time, we may suspend work on the matter after notifying you.
  • Fees are payable for the work performed and the time reserved. They do not depend on the outcome of an application, for the reasons set out in clause 3.

5. Your responsibilities

The quality of our support depends directly on the quality of the information we receive. You agree to:

  • Provide accurate, complete and up to date information and documents, and to tell us promptly if anything changes.
  • Provide genuine documents. We do not assist with false, altered or misleading documents or statements, and we will end an engagement immediately if we discover any.
  • Disclose relevant history, including previous refusals, overstays, criminal matters or pending procedures, since these can affect the options open to you.
  • Respect the deadlines set by us and by the authorities, and respond to requests for information in good time.
  • Take your own decisions. Our role is to inform, prepare and guide. The decision to submit an application, and the responsibility for its content, remain yours.

We are not liable for consequences that arise from information or documents that are incorrect, incomplete or provided too late.

6. Confidentiality

We treat everything you share with us as confidential. We do not disclose your information to third parties except where it is necessary to carry out your instructions, where you have asked us to, or where we are legally obliged to do so. Personal data is handled as described in our Privacy Policy. Our duty of confidentiality continues after an engagement has ended.

7. Liability

We carry out every engagement to the standard of care that may reasonably be expected of a professional immigration consultant. Our obligation is one of effort and diligence, not of result.

To the extent permitted by law:

  • Our total liability in connection with an engagement is limited to the amount of the fees you have paid to us for that engagement.
  • We are not liable for indirect or consequential loss, including loss of income, loss of opportunity, travel or accommodation costs, or losses arising from a delay, a refusal or a change of policy on the part of an authority.
  • We are not liable for the acts, decisions, processing times or errors of authorities, embassies, employers, educational institutions, translators, notaries or other third parties.
  • We are not liable for damage arising from circumstances beyond our reasonable control.

Nothing in these terms excludes or limits liability for intent or deliberate recklessness on our part, or any other liability that cannot be excluded under Dutch law.

Any claim must be notified to us in writing, with reasons, within a reasonable period after you discover the matter it relates to.

8. Cancellation and ending an engagement

You may end an engagement at any time by telling us in writing. Work already carried out and costs already incurred remain payable.

We may end an engagement if you do not provide the information or documents we need, if fees remain unpaid after a reminder, if we are asked to act in a way that conflicts with the law or with professional integrity, or if a working relationship of trust is no longer possible. Where we do so, we will explain why and hand back your documents.

Appointments cancelled or rescheduled at very short notice may be charged, where this was agreed in the engagement.

9. Intellectual property

All content on this website, including text, structure, graphics, images and the Quality Immigration name and wordmark, belongs to Quality Immigration or its licensors and is protected by copyright and related rights. You may read, print and share pages for your own personal use. You may not copy, republish, adapt or use any part of it for commercial purposes without our prior written permission.

Checklists, templates, overviews and other materials prepared for you during an engagement are provided for use in your own matter only and may not be resold or distributed.

10. This website

The content of this website is general information and is not tailored advice for your situation. We put care into keeping it accurate, but we give no warranty that it is complete or current, and we may change it at any time. This website may link to external sites; those sites are outside our control and we accept no responsibility for their content or their handling of your data.

11. Personal data

Personal data provided to us through this website or during an engagement is processed in accordance with the GDPR and our Privacy Policy. Cookies and similar techniques are described in our Cookie Policy.

12. Governing law and disputes

These terms and every engagement are governed by the law of the Netherlands.

If you are not satisfied, please contact us first at info@quality-immigration.com. Most issues can be resolved quickly in direct conversation. If we cannot reach a solution together, the dispute will be submitted to the competent court in the Netherlands, unless mandatory law designates another court. Consumers retain any right they have under mandatory law to bring proceedings in the country where they live.

13. Changes to these terms

We may amend these terms. The version published on this page at the time an engagement is agreed is the version that applies to that engagement. The date of the last update is shown at the top of this page.
